The DOJ aded: A department of JUST US report

(This is better voice related, I'll get back to you on that audios amigos)

It's like a Whose "HUGHES" of the news on elder abuse, after Gwen Hughes, the final defendant and lowest totem on the pole, recieved the stiffest sentence in the Kern Valley Healthcare District, elder abuse criminal case.

With Dr. Hoshang Pormir slipping thru the court "missedum" picking up his "not to do" list recently, followed by former KVHD CEO and political poles dancer, Pamela OTT, as she held her hand out palm side down this time to be slapped--last one out is a rotten egg.

Ott and Pormir were both sentenced on conspiracy charges (endangering public health) rather than the original elder abuse codes which were dropped in lieu of the "justice light" charges of this brigade from the California Depart-meant "to do" justice lead by Attorney General Kamala Harris.

Jerry Brown, former atturnkey General, now Governor of the state of mind that elder abuse "of the worst kind" was committed, divorced himself from those claims best used in campaigns and not court rooms.

The first two defendants were treated to a "buzz kill" or "stern talking to" before being handed over to the probation department--for three whole years. (wow) They also have to write "I will not drug and kill the elderly" four hundred times on a chalkboard.

Ouch!

There are different motivations for elder abuse, but it usually involves financial gain.

THe KVHD example of elder abuse shows there is a senior discounting on the oversight and justice par tof this bargain of a deal: protecting the innocent.

Politically motivated, Gwen Hughes, former KVHD director of Nursing, for all of six months, became a henchman for the group of administrators and board members hiding their already troubled Skilled Nursing Facility.

Evidence shows a trend toward understaffing the nursing home, which meant more infusion of cash into the operations and dehydrated patients the result.

Hughes was sentenced to three years jail time and in a few more years, as she is getting older, could be rolling to a senior living apartment near you. Though she has had to relinquish her nursing license forever more, and keep a distance of at least two bus stops and a senior center from anyone graying at the temples--WE do realize she will be aging and they won't be able to stop the potential for more senior predation.

Some people prefer to close the case, calling it just another example of lack of caring, or truth, but some never forget.

Dr. Hoshang Pormir sentenced 3 years probation...DOJ claims success

Dr. Hoshang Pormir was sentenced today in the Kern County Superior court to three years probation as he plead no contest to a "conspiracy" charge in the Kern Valley Healthcare District elder abuse case, as prosecutors agreed he wrote orders to drug his patients, but did not CAUSE their deaths. 

Pormir, who has been alleged to have had knowledge of the situation with his patients, according to witnesses NOT included in the California Department of Justice case, will have a felony on his record and will have some restriction as to where he can and will work continuing his career as a doctor.
 

Though co-defendant Pamela Ott, former KVHD CEO, with false credentials, and a working relationship with Pormir, hired Director of Nursing, Gwen Hughes months after the KVHD skilled nursing facility was cited for the use of "physical restraints, dehydration, weight loss," all known as "elder abuse"  Ott has also plead out and will be sentenced next month, Aug. 22.

Ott introduced Hughes to the facility and it's doctors and board members, accrediting Hughes with an "expertise" in the use of "psychiatric drugs" as in "30 years worth of experience" and this was also quoted in the small hospital's local newspaper shortly after the new DON arrived.


Hughes, however, will likely be the scapegoat, though she was responsible for the staff who administered the drugs, she was also a victim of the political climate, those trying to sweep problems under the rug, as only Ott and Pormir were involved in attempting to obtain a 12 MILLION DOLLAR BOND.

This was known as Measure M, and it came at a time that the KVHD SNF had major problems with both federal and state agencies. The six months Hughes came on was a relatively short period compared to other administrators overlooked by the DOJ investigators.

The Skilled Nursing Facility was under scrutiny in 2006, and Ott along with several co-conspirators, or board members, kept the information from the public and even law enforcement. No charges have ever been filed against any board members in this case.

First of it's kind...they say

As if it would somehow change the public perception, as if not enough manipulation has already been applied in this case, today, in the Californian article, The DOJ is supposed to have said this is a "first of it's kind" prosecution on "drugging for convenience." They didn't really add much more than to try use the climax of the case to make it look "not so dirty" what has happened.






(Prosecutor, Steven Muni, seems to have experience and education, but no shame, as this DOJ attorney has not gotten one single elder abuse defendant from KVHD to trial. Probation as it stands today, is all this prosecutor can muster from what Governor Jerry Brown, called the "worst case of elder abuse" he has ever seen.)

Or more likely to step away from the real reasons, the truth, as it played no role whatsoever in this case.

The case of the state of California was it's own agenda and a complete fraud and fabrication. I say that with the utmost certainty. And under oath perhaps, one day?

This blog and all it's contents, is dedicated to those who suffered and continue to do so. Some have died. And for those who were bullied and could not speak, this is their voice. It was and is my service to speak the truth in this case as best I can and for those who cannot. Not a burden whatsoever.

The truth never seems to be a problem for those who have it, it's those "have nots" that have the problem. 

Witness against the prosecutors...

These prosecutors who may not realize how hapless they really sound, may have gotten the notion that they could spin out of the responsibility with another manipulation of true events. It's so off key they will probably notice it with their own ears.

We are not privy to the underpinnings of what happened inside the Attorney General's office when now Governor Jerry Brown, lead his campaign for a new California Governor on the coat tails of cases such as KVHD.

Brown got down and dirty calling it the "worst elder abuse case" he'd ever seen.

Somehow, that seems hollow and self serving and maybe even sickening for some who look on as prosecutors from the state are watching the defendants in the Governor's words the worst, walk away with probation.

One could imagine the Governor "of Austerity" to have made a quick call, keep the press from tracing this disaster to his door step. And voila! Steve Muni, lead prosecutor, pokes his head from under the blankets long enough to tell us this is a "first."

Most hope that all involved will have some sort of last, I'm sure.

Where is Brown's Statement?

Peekaboo, we see you...Missing today is a statement from the mastermind of the mansion, Governor Brown. But it's not forthcoming as his ilk is cowardly and estranged from reality.

Here's some truth: This is the worst political ploy to help a "skin flint" gubernatorial candidate exploit his sworn office as Attorney General to springboard into a Governor's election, I've had the displeasure of seeing first hand. 

How's that? Different ring of truth when you apply real truth. 

His Press Releases were rolling like thunder onto the campaign trail and like a true politician, a true expert in deceit, he rode that wave of misery into the governor's mansion using every victim, every defendant, to raise the ire of all who could and would not harm the elderly. All who would vote for someone ready to change the situation for the elderly.

This really conveys to those who are not yet shocked by the deeds done in this KVHD nightmare about how far reaching this con game goes.

Governor Jerry Brown used the office of the attorney general, a position of trust and truth, a position of responsibility, to build an illusion of caring for those who were harmed, justifying a visit to our friends at ABC World News tonight, and Diane Sawyer, in a well timed, well viewed, friendly "elder abuse" segment.

(I guess raising funds in the AG office is easier. He created himself a hero to the elderly in those early press releases. Then was aided with some FREE stuff from ABC news.)

Sawyer gave Brown some feel good editing, a few repugnant expressions for the camera, you almost believed these two really cared about those patients and their horrendous fate at KVHD.

What hurts is that there are still those who put their trust in both Sawyer and Brown.

Candidate and AG...

But Brown started campaigning for Governor long before he announced his plans, refusing to commit to his candidacy, and continuing to launch a political campaign inside the AG office with all it's resources and his secret "campaign contributor. "

Here on this blog, is my prediction at least six months in advance of his declaration to run for office, of the AG Brown's obvious "pre-campaign" activities. He certainly had a way of churning out the PR and creating himself in a certain light.

Later the LA Times and Sacramento Bee would question his use of the AG office as a springboard. But as is standard for those tied to the money, the political quote fest, they allowed the issue to go away. These gatekeepers decide who they will shut the gate on and it wasn't Jerry Brown.

However, any attempt to nail down this other Brown deception, could lead to "his" current AG having to raise at least an eyebrow if not a finger. 


Who is in charge now...

Kamala Harris didn't  make a stir about elder abuse, but she did benefit from Brown's hyperbole as KVHD the worst he has seen, as she rode along with the would be, could be, wanna be, on the campaign trail in 2010.

Well, she's our AG, the one who would be obligated to ignore her mentor, Governor Brown's slight digressions from the truth. I'm sure she's just brushing it off or walking it off...all that shame.

Harris, supposedly a hard core prosecutor, out for families, those who need justice, has sat quietly, not answering to the lowly types such as myself who continue to ask why?

Ducking and hiding wasn't too necessary as I've been busily pointing fingers on my own for a while now. Only recently has any other publication or media outlet even noticed anything.

PBS, is a place to find the story, but it's a story. Again, there is the truth as we experienced and witnessed it, and then there's the spin, those who use misery to gain attention themselves. Such as what PBS did in a upstaging fashion. Details on drugs as if the whole story was to be used at a medical convention.

AARP where are you?

I asked this question of the legal department of the AARP, which claims to be a significant benefactor for the aged and elderly.

The little communication I had with this massive corporate sell out of aged people everywhere, simply checked in to KVHD under Fire, lit up momentarily to apologize for not looking into the druggings, and then left off as I suggested they ask Kamala Harris what was happening with the case.

This is what they actually did. lol They looked, then called our current California AG and POOF, disappeared. So, I would not rely on their next "the best nursing home issue" of 2012 to be accurate and forthcoming.

AARP, may not stand for anything after all.

Dishonorable mention goes to...

While there is some speculation on my part that the presence of high powered attorneys Donald Etra and William Howard 'Ginsburg played a crucial role in obtaining these lackluster plea deals, and then to have them drop off the face of the earth, to be replaced by "public defenders" made this all the more madcap.

Etra a visitor to the George W. Bush Whitehouse, and Ginsburg attorney for Monica Lewinsky, whose chubby, child like,  good looks were far too much for President  Bill Clinton to resist, were here and then gone in the KVHD case. Though I must say it was a fun twist when I caught them all on video. (see youtube)


Pormir and Ott both have had financial help at the direction of several of the KVHD board of directors.


Hughes was never given monies for her criminal case. Nor any help with the civil cases either. But she sure looks like their target.


Donald Etra left the case, with no communication, and has not answered any further inquiries. Pormir's current "cheap legal guy" some sort of half legal clerk and half the price, Fred Gagliardini, has denied any potential plead outs was made prior to his services being sought as the defendants have been given the "below sticker" price deals thus far.

But Mr. Gagliardini, wants us to believe he himself was responsible for settling this elder abuse matter, no influence from the big time attorney's whatsoever.

I would tend to disagree. 

Likely, the influence of the influential was just that. Etra and Ginsburg cared for no one. They were there flexing some muscle, and if I'm right, they loosened the lid A LOT for the public defenders to follow.

Final thoughts...

There is no way to take back the pain these people have caused, all of them. But rest assured none of this goes unchecked. None of this is okay, right, believable or worthy. And I was a witness to these events. I have researched, I have uncovered, questioned.

And the truth will always prevail. It's the only thing real about any of this...

Etra and Ginsburg: new attorney's in the Kern Valley Healthcare District case

(UPDATE: Sept. 2010:Donald Etra was a former attorney working with Ralph Nader. He moved on lately to high profile Hollywood cases. His client is Dr. Hoshang Pormir, the medical Director of the nursing center and ER. Dr. Pormir is charged with elder abuse. He has also hired William Howard Ginsburg who was the attorney for "Monica Lewinsky." The two other defendants in the KVHD elder abuse case, Pamela Ott and Gwen Hughes, have their own attorneys but they also maybe putting their heads together as I attended a hearing (on our YouTube site) and watched them shove Ott in the backseat of a car and the attorneys, not Dr. Pormir, and Ott all left together. Hughes is seen in the video leaving in her wheelchair. What is going on now? The defendants will be back in court to answer to the charges which could lead to a trial or they still have the opportunity to make a deal. If Monty Hall comes as their lawyer next, we will know what has happened...)

Who are they and what are they doing here?

I apologize, but I have not been able to verify much so far regarding the new attorney's in the KVHD criminal case surrounding the use or some will say, misuse, of psychotropic medications in the skilled nursing facility for six months during 2006.

Two new names, possibly big names in the world of defense attorneys, Donald Etra and William Ginsburg, who have been recently attached to the case, but we have no "verification" of how they got here and what their particular roles are.

What I have learned so far is that Etra is the attorney for Dr. Hoshang Pormir, a defendant in the case. Etra is thought to be taking the place of the previous criminal defense attorney.

Ginsburg, is the twist. His presence or actually I have not confirmed to my satisfaction what Mr. Ginsburg is doing in the case. And I have again not confirmed that he is the Ginsburg who was involved in the Monica Lewinsky drama, case, or whatever you want to call it.

I was told he was involved in another case for Dr. Pormir, one with the state medical board.

Again, I will get back today with that information if at all possible.

I thought I would ask

I've sought the assistance of a few media outlets and the Bakersfield Californian newspaper in helping to find out what sort of turn this case is taking and who are new players on the field.

Though, there are the media outlets who have been using our story for their own purposes, not remembering that this case took place in 2006, and forgetting there is another side: a new administration and new CEO. I would suspect the new administrators wouldn't mind giving their side of the story after the media has stuffed itself at the buffet we seemed to have arranged for them.

At the end of the year our story made a local outlet's year end shocking stories, and I kind of shook my head in disappointment when the article read something like: "they were giving out psychotropics like candy."

Yeah, thanks, that helps. (I know all these people who have reported on this were right there, bedside, or they were too lazy to go past a politically motivated report from our attorney generals office. Hey, other media outlets don't forget that Pam Ott was once a "witness" and now a defendant. And the pharmacist was once a defendant and now a witness. And the witness for the state scrutinizes the hospital medical records. The former CEO of the hospital shreds the paperwork leaving only what she thinks anyone should see. Yeah, rely on that and you'll go far.)

The media outlets were giving out "shockformation" like candy to their readers who unsuspectingly thought they were being treated with respect...

Extra, extra, read all about Etra: Donald Etra celebrity law cases/Jerry Brown angry Howard Stern

Here's some extra information on Donald Etra, who we understand to be taking over the defense of Dr. Hoshang Pormir as the doctor's criminal attorney in the state of California's elder abuse case against the Kern Valley Healthcare District employees.

The other two defendants in the case are the short term director of nursing for the KVHD nursing center, Gwen Hughes, being represented by Bakersfield criminal attorney, Bruce Blythe, and the former CEO, Pamela Ott, who resigned shortly after the state put the hospital nursing facility in immediate jeopardy, heading toward closure in May of 2007. She is being represented by another local attorney, Jim Faulkner.

Etra could make this a different kind of case

With a new attorney of some merit and caliber taking over for a client on this case, a doctor in fact, changes the face of the whole case. Look for part two of the political implications of the presence of Donald Etra, coming soon.

The rapper's gentle rap

Rapper, Snoopdog, according to this Sept. 2009, article in the Orange County Register, was arrested with a gun and some marijuana.

His attorney, Donald Etra, the new player in the Kern Valley Healthcare District elder abuse case as of Jan. 5, told reporters Snoopdog had a prescription for the marijuana.

But the attorney went on to defend "Snoopdog" says the author of the article, referring to the charges as "bogus."

Now, I've made that very same accusation about the investigation and ultimate charges in the Kern Valley Healthcare district case. The word bogus is hanging at the front door of this blog.

Etra has been linked with other celebrity cases such as with Chris Brown and Rihanna, which makes me wonder about Etra's current interests in law.

His background, which we will go into in part two of the other article, is rather eclectic considering his foray into the celebrity world.

Jerry Brown and Howard Stern

The politics that have taken place so far in our particular case have been local power mongers, the bottom feeders.

But with our Attorney General on ABC World news last week, and now the presence of Etra, things are rather confusing now for most of us locally, who would just like to keep our hospital, but keep it safe.

Howard Stern's attorney gave our California Attorney General "guff" about pouring money into the Anna Nicole Smith investigation and using it as a vehicle for his campaign for governor in the article below (click on link).

(I believe you will find similar remarks on this blog, as I thought it was horrific for the AG to take the time to fly down for a photo op on this Anna Nicole Smith business. It was in the faces of the people who have been hurt repeatedly here in the KRV. Family members, patients, employees, the list goes on. )

I must say I repeated a very similar sentiment in that our AG, Mr. Brown, passed us up, as he flew right over us to LA for the public relations event of the year with Anna Nicole Smith and then Michael Jackson overdosing on some strange drug.

But this little valley, hurt and harmed in so many ways, we could use justice. We don't want your press conferences and ABC World News stories regarding the continual retelling of the most graphic scene in our whole nightmare.

We want you to acknowledge what happened in 2006 and 07, which revolved around a systems failure in the nursing facility run by an administrator with improper credentials.

We need to be helped. We still have participants to the crimes at the hospital, working, getting a paycheck, retirement, and yet nothing is done.

We could use some help. But it doesn't seem to be something that has been given out much here.

How about a press conference Mr. Brown? (call me) And welcome aboard Mr. Etra. There are many articles to read about you...I'll add more links soon.

Is it safe to go to the Kern Valley Healthcare District for care?

Updated (the woman who I reported as being abused was tossed back to me as their didn't seem to be concern. Shortly after I reported this the hospital has now contracted with a Domestic violence and rape center which will refer all their victims to the hospital for rape tests. Interesting, but how about the woman I reported?)

Where has all the money gone?

Medical care is a tough industry, it requires specialized training, long hours away from family, decisions that effect the lives of patients and families, and it can kill if it's not done right.

Errors in medicine lead to lost lives, careers or disabilities such as the one I have as my doctor never told me Gentamycin could cause me to lose my visual stability, balance and my former life.

I wasn't warned. It wasn't fair.

However, I'm warning you now that there is nothing over the counter, under it or on it, that doesn't have the potential to harm you, your children, your pets even.

But when a hospital is simply getting by, cutting staff, hiring doctors that don't necessarily fit in with the community's needs, and cutting costs everywhere, then, yes, you are in danger.

This is no longer a safe place to get medical care. Somebody said to me today, "I wouldn't go there anyway, I'm not stupid."

Well good. Because now that I"ve warned you, you are responsible for the decision to go to a district that lies to it's constituents regarding it's financial situation, and drops the responsibility onto the patients.

For instance, I wrote a post about a woman being seen in the Rural Health Clinic a week or so ago, and she was being beaten up regularly by her boyfriend. The woman is in her sixties and Dr. Nadler has been treating her injuries.

They are not just injuries they are crimes.

I wrote to the hospital and updated with all the information I had for this woman and they sent me a phone number to call.

No.

You call.

I will make that call and reroute them to Nadler who may need some extra training in identifying these types of situations.

And now the hospital retreats from really caring about this woman.

Look she's just poor, maybe as they like to say here, "a charity case." So, they let her get beaten up, and walk away.

Do you think this is safe? Shall we go on?

A classic case of abuse and the doctor who sees this woman rather regularly can't even identify her.

Again, I will repeat, if anything happens and you think you may find help here in the KRV, I say, I doubt it.

They are worried about money, and your tax money, but seemingly not about you and your safety.

I wonder if there are any abused children at the rural health clinic that they missed?

It seems though, that the aged and elderly get the worst of it here, like in the nursing center. But the woman who is being beaten is more than 60 years old. And nobody noticed her.

She is too afraid to talk. She's too afraid she won't have anywhere to go. That means something, to me, only, I guess, because the ball got tossed back in my court.

Is it safe?

This isn't any business, this is supposed to be the business of caring. And if it is only the numbers, then no, it's not safe.

With the prejudice that has occurred here, there's too much to tell, it will be part of a fictional, but unfortunately true, account of what has happened to people in this valley in regards to their health.

The hospital is sick, and only it's patients can save it. It's blind when it comes to it's awesome responsibility to the people it serves. We must be it's eyes.

When it can't hear the cries for compassion, the longing for care without judgment, then it must hear the things I'm saying. Not easy is it?

Why are we paying so much for mediocrity?

Dr. Nadler told an audience in 2008 that we the community should be grateful for his presence here, and his student loans which forced him to come here.

And had we spent our money wisely we could have had any doctors we wanted, but we are like people with no self esteem and end up with doctors who mistreat us.

I miss Dr. Pormir as he never raised his voice to me, always listened, was often scared of me, but his face was there the night I had the stroke and the ER doctor was yelling at me that I was "drunk."

He politely intervened on my part, while others wanted to believe it was alcohol or I was overtaken by the fumes from the cow manure piled up in the executive board room, Pormir straightened it out.

Pormir, who is now facing criminal charges for something three board members, a CFO and CNO and CEO, did to this hospital and community, is very much missed by many of us who are now afraid of the new administrator of the ER.

(Update: Dr. Pormir, surrounded by famous attorney's Donald Etra and William Ginsburg, has seemed to forgotten that the truth is more important than anything else. I must say it is disappointing to see Pormir, who at one time I and many others considered him our friend. But it looks like Pormir has not shared all his information. For instance, in December 2006, he came to my house to bring me a Christmas present. We ended up arguing about the Ott/Hughes attack of the Knights at a Christmas party. Pormir told me Hughes was "highly qualified" and was doing a good job. New Question: Will Dr. Pormir risk taking the witness stand as he recently greeted his co-defendants with a hug? I sure would like to know as I at one time thought Dr. Pormir was an honest man.)

The left side of my face is still numb, but I don't slur anymore. And the fact that this doctor who treated me that way during a frightening event, is still there, makes me say: it's just not safe.

If you have to go, just don't go alone.... (it's all yours Cal Mtg.)

Donald Etra current attorney for Dr. Hoshang Pormir: still don't know about Ginsburg

UPDATED: Currently it Donald Etra is heading up Dr. Pormir's criminal elder abuse case, and William H Ginsburg is handling the medical board issues. It is still not clear how these attorneys have arrived here and what they are getting out of this as they have been quietly in the shadows watching the circus in town.

According to the felony department at the Kern County Superior Court, Donald Etra, the much talked about attorney, (actually I'm the only one doing the talking, but I can talk a lot) is relieving Dr. Hoshang Pormir's former criminal defense attorney, David Torres.

Although, I have tried for a week to contact both Mr. Etra and Mr. Ginsburg, I have not had an email or phone call returned, as of yet.

I wrote up a few questions and have sent them to Mr. Etra in hopes that we can get an understanding as to why high profile attorneys are at our doorstep.

But there are many doorsteps

We have no high profile attorney's helping the hospital reshape or reface it's scarred visage and there is little in the way of people openly talking about all of the issues leading up to the trauma at the hospital.

There was the doorstep to leadership. We had an administrator without credentials, but even more so, without compassion. Someone who would allow families of nursing home residents to go without news of their loved ones, whether it be emergency situations, or simply not involving those closest to the situation to be included in decision making.

This leader also was given this power by three members of a five member board of directors.

Where are the psychologists who could really analyze this situation from that perspective?

Where are the people who could help those traumatized, young nurses who were threatened that they would lose their license had they told that a certain patient may have been given a drug against her will?

And the older nurses who went out on "stress leave," how often do you see a cluster of previously stable and enduring staff suddenly leave due to stress?

But we have attorneys now who have interesting backgrounds. We will hopefully hear from them soon and maybe get an idea as to why they are here and how they got here.

(My question will always be to the government outlets, the political Representatives, the media: where were you when we really needed your help?)

URGENT NEWS: who is who, attorney in KVHD elder abuse case unclear at this point

Who is the new attorney:

After almost a week, I find tonight that there is nothing clear as to who the "new" attorney is in the Kern Valley Healthcare District criminal case, which has three people charged with elder abuse stemming from a six month investigation by the state of California Department of Justice, in 2006.

I've reported that Dr. Hoshang Pormir has a new attorney in Donald Etra, a high profile attorney who has worked with the likes of "Snoopdog" and other celebrities. Etra, also linked to Ralph Nader, and known as a "firebrand" and consumer advocate, has a broad background even defending death row cases.

However, I am not clear at this time if that is indeed correct.

It all started last Tuesday...

We could not seem to be able to get anyone down the canyon to the courtroom on Jan. 5, where KVHD former CEO, Pamela Ott, former director of nursing Gwen Hughes, and former Medical Director, Dr. Hoshang Pormir, were scheduled for a 9 am status update and possibly setting a date for the preliminary hearing.

None of us made it, so I called on several of the TV stations in Bakersfield to see if they had been in court and had the update as to what happened.

When two stations I usually rely on for information, channel 17 and 29, were out of the loop and had nothing, I decided to try another station, ABC, channel 23.

As I reported in the story last week, I spoke with the local ABC affiliate last week and was told that the court case had been postponed because one of the defendants had changed attorneys.

I asked which defendant and they did not know. Then I asked if they had the name of the new attorney: they gave me Donald Etra's name, and an email address.

After a few moments of questions about me and my interest in the information, I directed him to the blog.

I called back after I didn't find Etra's name listed amongst the Bakersfield law section of the yellow pages.

I verified the name and spelling.

So, I googled him. Apparently, so did someone else, who sent me an article about Mr. Etra and his friendship with George W. Bush, and other "important" types.

I waited until the afternoon to call the court and get the verification. I was told by the "felony department" of the Kern County Superior Court that indeed the case was continued because of a change in attorneys.

Then I was given the extra information, that the defendant was Dr. Pormir.

He was not the one I had guessed earlier in the day, but it was intriguing for several reasons I won't go into right now.

So, I had the first part of the story verified, but then I had to put a call into Etra's office, which I did. I asked the woman who answered the phone that I wanted to verify that Mr. Etra was indeed the attorney for Dr. Pormir in the criminal case. She took the message.

No call back, but not unusual. I called again today, repeating the same thing, I wanted to verify he was indeed the attorney on the case. Now he's got a voice mail from me.

After looking at the Kern Country Superior court site, I found I could not verify anything there with any certainty either.

But it didn't end there.

Do you remember who Monica Lewinsky's attorney was? Do you even remember who she was?

Regardless, now we have the possibility that William Ginsburg, Lewinsky's old buddy, maybe the new attorney in the case.

There has been some information coming in that there are those getting calls from this office, Ginsburg's, and this all has to be confirmed of course, but there seems to be some very confusing things going on.

Bakersfield Now and the Kern Valley Sun only one's with Elder Abuse stories

UPDATE: I find it interesting to go back over this blog as it seems a bit haunted, as I say things, and funny enough they happen. This post is no different as the June preliminary hearing was reset until August, as the court could not accommodate the continuance requested for one week by the Department of Justice who had an expert witness on vacation. Okay.
Boy, the Attorney General Jerry Brown did go on the path of the Governor's office. Great, now there's absolutely nobody to call if there are problems. I say this because the state's case is a "loser." There's no way Muni is going to get this botched investigation past our new lawyers for Ott, Donald Etra. Woops, he's Dr. Pormir's attorney or is it Hughes? If nothing else they like to take car rides together, all of them.
The cries for help, the botched investigation, the lack of interest other than a bid for the top office from the state.
It's sad.
But after Mr Etra and Ginsburg passed through our town a few months ago and had a visit with what they said was a simple gathering of support for Dr. Pormir, they ended up with a story and some documents. Not exactly a nice thing to do as the duo teamed up with Jim Faulkner and Bruce Blythe, helping the three left to face...the ominous, no...sloppy DOJ.
I'm going to open this thing up like a wound soon, and you the reader, the players, whoever you are, you're going to be up here on the plank.

I, of course, decided to sleep in on this court date, let someone else do it, I thought rolling up in my comforter would be better. And there they were, the Kern Valley Sun, finally doing their job. ZZZZZZZZZ

Though, Bakerfield Now, had the early edition of the story, it was one long paragraph, with the facts. It was out on the internet before 2 pm.

The Sun came in later, but they had the best picture of Ott and her attorney, Jim Faulkner, it's worth taking a peek at as it seems the editor jumped out of bathroom or a hallway and scared the two of them. For Ott fans you may enjoy that look on her face, something out of a B movie.

Unfortunately, the facts were not correct as they tried to overwrite rather than sticking to the latest, basic facts, where you can't go wrong.

In the Sun article, Perfect said that Pormir, Hughes, and former defendant, Debbi Hayes, were all charged with assault stemming from an incident where a resident was held down and given an injection of Risperdal, a very strong antipsychotic which has to be given in slow, smaller doses, or the patient could possibly react and die.

However, It is former Director of Nursing, Gwen Hughes who has the assault charges, NOT DR. PORMIR (that's for the hard of hearing) or Ott. And Debbi Hayes has no elder abuse or assault charges against her, as she is a witness if the case goes to trial.

And the other error that admittedly the Sun would not know about was that the woman allegedly given this shot of Risperdal, Louise Zimmerman, the date is incorrect as to when it occurred. (That's a whole other story isn't it DOJ?)

Another thing that is irritating to a reader about an article of this magnitude is the repetitious information which came from last year or the year before. I think if you ask any nurse working in that hospital at the time, not that many work at KVHD now, but they will tell you the repeated mantra about the Ombudsman in 2007, makes people believe it was real.

All that is is a statement from the DOJ report in Feb. 2008, but the information has changed, and the truth is there were complaints early in 2006, all the way thru Jan. of 2007, and they went to Ott, the board of directors, the public health department, the Kern Valley Sun Newspaper, a freelance writer, yes, the state and local ombudsman, social services, and exactly how many other places were these people supposed to go?

That kind of reporting makes for slippery information which can't be backed up with paperwork, only by an ancient, inflammatory statement from the attorney general's office. That's selling cheap information, a second grader could do that with blunt scissors. A cut and paste job.

But as far as winning the race and bringing along a few good facts, and the best picture, the Sun, attempted the job and brought part of it home. ''

What about the timing of this

Though I wish the Sun had gotten a picture of mysterious attorney, Donald Etra, who came on with Dr. Pormir last month, I would love to hear some details about him rather than a press release sort of thing.

Since only two outlets covered the case, as I called the rest, and one called me, I'm assuming the Sun and Bakersfield Now (channel 29 and 58), are the only ones inside on this case.

I'll find out more.

Now, we have three months, and they have finally set up the preliminary hearing date which goes the day after the pre-preliminary where anything can happen and usually does.

But progress has been made, date sets, but what about that June date? (see update)

There are a lot of brides in June, could it be someone is getting married to say, an election bid for governor?

If current AG Jerry Brown goes on to win his parties' backing and go screaming for the mansion, doughnuts on the front lawn, it would be prudent that he prosecute our case since it has gotten so much publicity, right Diane Sawyer. And now, right Cathy Perfect?

But if he looks like a long shot come June, we could see our case dropped like a hot rock.

So, it comes down to politics, not justice.
