There is something in the air and it doesn't smell like flowers. Apparently on Friday June 1st, the state of California, decided to give elder abuse charged, Dr. Hoshang Pormir, a way out of a trial which was scheduled later this month.
Pormir, and co-defendants former Kern Valley Healthcare District CEO, Pamela Ott and DON, Gwen Hughes, were scheduled to stand trial on allegations of elder abuse on June 25th of this month.
However, it appears initially that Pormir has plead no contest to a "conspiracy" charge and all other elder abuse charges have been dropped, according to the Kern County Superior court website.
But why so quiet?
If you will look at the pic to the right you will see that the charge the doctor plead out on begins with the sentence, "If two or more persons conspire..."
As of today, there are no indications that the other defendants have been given this same opportunity, but this still does not account for the idea of conspiracy. We will need to wait as I expect there will be more information coming out shortly. Or if it doesn't we may have to go and get it to come out.
There is no question that conspiracy charges could be given all around at KVHD for many reasons, but this is a mystery as of now.

The Preliminary Hearing in Kern Hospital Elder Abuse Case begins: media gets the axe
KVHD Elder abuse preliminary hearings...
The California Attorney General Jerry Brown's elder abuse case against former employees of the Kern Valley Healthcare District began it's preliminary hearing today at the Kern County Superior court and I was asked to leave...let me explain, if I can, the day I had...
I arrived for court this morning to find all the defendants, former KVHD CEO, Pam Ott, Dr. Hoshang Pormir and Gwen Hughes chatting with their attorneys, Jim Faulkner (Ott), Gwen Hughes (Bruce Blythe) and Donald Etra (Dr. Pormir).
Last Friday I had filled out my media release to film in the court room and I explained that to the bailiff, who then allowed me in to film.
As we filed into the courtroom, Ott and her friends, likely her mother and sister, sat behind me, "hey let's sit behind Laura Hart," she said.
I ignored the remark and began fiddling around with my camera and kept looking for my pen which eluded me all day.
As is usual in court, 8:30 turned into 9 am, and then the judge called the case #BF126665 A, C, D, to come back at 1:30 in the afternoon. Steve Muni, representing the state in the case, asked the judge that they proceed today as there was a witness on hand to testify. With that said, we all left and went our own ways.
We were whisked in and out in all of five minutes, and I had taken, maybe 30 seconds of video.
I went off to attend a doctor appointment, early, as I had expected to go later in the day, had something to eat and came back.
When I came back Ott and her friends were sitting outside the court and I walked up and took a few seconds of video while Ott acted as she can do, friendly, asking me how my health was doing. I wasn't interested in being drawn into a fake conversation or anything else, so I went inside while she was still talking.

When I arrived I again got out the camera and was taking some footage of the court room door as Gwen Hughes sat quietly, alone, in her wheelchair in the hallway. (I'm not using any of the photos I took inside the courtroom as I'll explain)
When I got home I couldn't stop thinking about the media issue, so I called the court and asked if I could write a letter of explanation or apology to the judge regarding the misunderstanding about the video. I was told that there were no ex-parte, private communication with the judge. If I wanted to do this, it would be put in the case file.

Two Deputies approached me and said I had filmed without permission and put it on KGET the noon news. I was told I had to take my camera and recording equipment out of the courthouse.
I explained to them I had not used any of the film as if there was any to use, and that I was at my doctor during the break. Can't argue with people in uniform, but I did end with it wasn't me who did the filming and broadcasting, I'm on the Internet.
Off I went, left camera friend behind, and returned to deal with the situation. I filled out another media release, as I was told I did it wrong too.
I had my notebook and that's all I needed, so we all went into court at 1:30 pm and the judge did some juggling of the schedule so that they could move on with the preliminary hearing.
But before we went on, Ott's attorney, Jim Faulkner, told the judge that I had filmed without permission, and it was broadcast.
Judge Lua, apparently looking at my paperwork, denied me permission to film or record anything. Then KGET had a media release, and the judge asked the defense attorney's what they thought about having cameras if it would be "fair" to their clients. They didn't want the cameras.
So, the judge denied the second media release, meaning the preliminary will likely go without coverage.
I was dumbfounded as to this turn of events. The judge had me stand up while he denied my release, I didn't respond, as I wasn't sure why he was doing this, so I didn't have much to say, except, "Okay, your honor."
But then Steve Muni reminded the judge of my blog, and that I had sent in some evidence, and that I may called later as a witness.
The judge responded by asking the defense attorneys if they would be calling me to testify, and they responded, "yes."
So, am I a witness for the prosecution?
If I am then I would be happy to answer anything the defense would like to ask me. I have nothing to hide, except maybe some embarrassment, and have no fear of taking the stand.
What I've learned about liars is that they have to think about the story, I don't, as you may notice from this blog being hopelessly redundant: I lived it.
What I have witnessed was serious enough for me to be concerned for the community here in Lake Isabella as well as the people from Sierra Kings District Hospital in Reedley, where Ott left after being charged with elder abuse. Sierra Kings filed for bankruptcy shortly after Ott left.
By changing me to witness status, it could be a way to keep me from knowing what is going on, but they did deny KGET Channel 17, but I'm not sure why as they didn't use any video, weren't even at the court room, and the story was basic using archive footage.
KGET could try to get back in court, but as of now I will discontinue coverage until I know exactly what they want from me.
Judge Lua told me I had to leave because I was a witness and I stepped out. But I still wonder what happened today.
They want a fair trial or preliminary for Ott, Pormir and Hughes, maybe take it up to Fresno County...probably not. I do understand that they want to be treated fairly, but what about the patients in this nursing center, their families and the employees at the hospital? I suspect they want to be treated "fairly" as well.

I found this disconcerting and will put the link at the end for all to read.
We know the Kern Valley Sun Newspaper won't cover it, nor QAB radio with jock and KVHD board member, Bob Jamison (the only two other news organizations covering the valley). And TV is all about the pictures, which leaves The Bakersfield Californian.
So, for now, I'll hope that the court, the law, and the state can manage to keep this "can of worms" from wriggling out of the can thereby missing those big trout, and I will play by their rules.

KVHD elder abuse case possibly delayed again, June 22- Gwen Hughes filing bankruptcy?
The Kern County Superior court website is indicating there is will be a continuance request coming up June 22 rather than the much awaited preliminary hearing to see if there will be a trial ahead in the Kern Valley Healthcare District Elder Abuse Case.
The website also notes that defendant and former Director of Nursing, Gwen Hughes, is filing for bankruptcy. This may be the cause for the continuence but we won't know until Tuesday when the judge decides.
I will take the court date off to rest and will gather information for the blog that afternoon and give you an update.
The blog is being rearranged and you will be able to find much of the earlier posts now moved forward to be reviewed once again.
If you haven't read thru these posts they include taped interviews, radio defense team work, documents and news on the attorneys in the cases.

Broken News: Elder Case set for preliminary hearings June 22 and June 23; of this year I hope...
Preliminary information has the three defendants in the Kern Valley Healthcare district elder abuse case in court today, and the preliminary hearing is finally set, for late June, when summer school begins.
(Gosh, they have to have summer school, we did well during the regular school year to avoid that very thing)
I'm sure there are more details, and I'll be back later when i find them.
The only regret I have is that I didn't throw on my Nikes and appear in court to find the latest attorney in the case, Donald Etra.
But if this information is correct and the preliminary hearing is set, then we may have a chance to see this case "spilled" in court. I would love it. I would only hope that other witnesses from the hospital would appear, or actually a nice thick subpoena would be delivered to those who thought they could escape their responsibility.
I apologize, as I leap ahead, but I didn't spend the last four years of my life studying, researching, writing to see the culprits skitter under the floorboards to escape.

KVHD presents: Flu shots for the communtiy/Ott countdown/YouTube/Bob Jamison gets "cracked" on his show this morning
Quick update: Word is that there will be a drive thru seasonal flu shot clinic on Nov. 4, from 9 am to 2 pm in the front parking lot of the Kern Valley Healthcare District hospital.
Costs are $10, but those with insurance need to check with their providers to see if there is any reimbursement available.
So, a little late but worth the wait. Hopefully the hospital will have obtained enough of the vaccine to catch the rest of us who have not had our shots.
Got a court date with a former CEO I just can't miss:
I won't be at the drive thru shot clinic, because November fourth is a big day in this valley not just for vaccines: it's the preliminary hearing date for the elder abuse case starring the leader Pam Ott.
It will be worth missing the flu clinic to have the camera in court to see exactly what the state of California is going to do. Will it be plea deals or is the Attorney General Jerry Brown serious about following through...we will see won't we.
Next week: the countdown begins, and you will finally get a look at our video from Ott's resignation in 2007. There are only four new videos up currently on our YouTube site, but I'm going this afternoon to try and get you thirty more.

Oh, the story is interesting, but you should follow up with the videos for a real feel for these people.
Quite unbelievable radio today on QAB:
Bob Jamison, KVHD board member, Pam Ott supporter, and radio talk show host, got his name a bit smeared this morning by a listener who didn't like his regular nonsense about medical marijuana.
Apparently, Jamison had a flyer he said was "found" in Bodfish canyon, which was an invitation for medical marijuana event.
As he went on making this some hot issue, the police were supposed to be interested in (it's medical marijuana, Bob, and its quite legal) he took a call from the community.
Now this is really funny and quite fitting, as Jamison uses this radio outlet to attack all who come against him or something lodged in his mind.
This is what happened: The caller came on and asked about the flyer, then told Mr. Jamison she was the one who organized this event.
Then, she said, Bob you drink, so what are you talking about? He began to answer, and the caller told him that she and her son lived in the valley for 20 years and that Jamison was known to drink and beat his wife.
Yeah, we're all agog about this. He finally got a taste of his own medicine on the air for all who listen, (a few left I guess), and it was fitting.
I make no claim to know Jamison's alcohol intake or how he treats his wife, that's their problem or her problem or whatever. Maybe the caller knew more than I did about them, but I don't need to attack him on that level, it's way too easy simply criticizing his lack of ability as a board member.
It's the fact that Jamison was attacking someone on the air about their medical marijuana event, party or whatever, thinking that he was safe and then the caller turned it right around on him.
Go get him Kern River Valley...Don't let him think that he can broadcast an attack on you and not expect some retaliation.
(I've been under attack by Jamison, and for some reason, he seems to think that this is okay, but what I'm doing here on the blog isn't. Hypocrites and cowards always can dish it out, but can never take it. But I would not have attacked him personally regarding his drinking or his wife. The caller did that.
So, you know, both Mr. and Mrs. Jamison felt they could freely defame me, and called me a drunk and other fun things, in front and to people who know me. I'm not a drunk, but he and Mrs. radio broadcast, felt no compunction about this kind of attack. Aside from all the other ones about how I was slanting stories about the problems in the skilled nursing facility at the hospital, yeah, right.
Mr. Jamison, from 2007, his famous attack pose, threatening lawsuits, physical violence, and calling Pam Ott leaving the district, "a tragedy."
Jamison at a recent KVHD board meeting in 2009, looking more subdued, but nonetheless, still dangerous as his attacks on people in the community via QAB media, make him quite the popular dinner guest about town.

It's official: Ott now appearing on the Kern County Superior court website

Not all information is up on the Kern County Superiority Court website regarding the former Kern Valley Healthcare District, Ceo/administrator, Pam Ott's "not guilty" plea today against elder abuse charges and a conspiracy charge as well.
Ott with attorney, Jim Faulkner, bringing the now defamed, CEO, to court to face her five minutes of fame, as she was set back out on her own recognizance, with only the provision she doesn't work in a nursing home.
Faulkner claims there is no evidence and no case, and he will show this if and when it goes to trial. (Oh my, what Faulkner doesn't know yet)
But keep your eye on the site as more information will be up shortly. (Now Ott is defendant "D", but what I want to know who will be E, F and G?)

BREAKING NEWS: KVHD former CEO, PAM OTT, INDICTED
Sources say Pam Ott will be in court this week to face charges in the elder abuse cases involving her time as administrator/CEO of the Kern Valley Healthcare District.
Although Ott is one of many responsible for the chaos and system breakdown which took place at the KVHD nursing center, and one of several administrators who fled the scene as civil lawsuits, threats of closure and exposure, were looming in 2007.
More than two years after, Kern Valley Healthcare District, CEO, Pamela Ott, resigned during the crisis in the skilled nursing facility, sources say that Ott will be in Kern County Superior court on Tuesday, Sept. 8, to face her indictment and responsibilities for her part of what happened at KVHD in 2006/2007.
With an on-going state investigation netting enough evidence to bring Ott back to Kern county where she originally fled from as the KVHD nursing center was on the verge of closing because
of poor practices, possibly lack of knowledge, but certainly lack of oversight by the hospital's administrative team.
The original three indictments, from Feb. of this year, but regarding the time period of Aug. 1, 2006 to Jan. 25, 2007, of Dr. Hoshang Pormir, Gwen Hughes, Director of Nursing and Debbi Hayes, Pharmacist did not fit the evidence of those closest to the situation.
As to others who still linger at the hospital, there is no word, if there any other indictments coming up. We will be watching closely.

Brown Jr., agents from Medical Fraud and elder abuse, could bring truth to the case against the district, it looks like a new defendant, former KVHD CEO,Pam Ott, will most likely be facing a judge this week.
Although Ott is one of many responsible for the chaos and system breakdown which took place at the KVHD nursing center, and one of several administrators who fled the scene as civil lawsuits, threats of closure and exposure, were looming in 2007.
But Ott was the leadership, and it was the leadership who tried to escape responsibility for their actions blaming it on others, covering tracks and creating scapegoats.

The administration led by Ott, ignored or punished negative information from the employees, the press and residents of the Skilled Nursing Facility as investigators from the state's Medical fraud and Elder abuse Bureau of the Department of Justice set upon the hospital.
Recently, things began to change in regard to the investigation, and on August 14, the state put another charge onto the pharmacist, for conspiracy, injurious to the public. Hayes, plead out on the count, receiving a one year suspended jail sentence, and three years probation along with community service.
The Pharmacists role in the upcoming court hearings is still speculation, but she may end up as a witness in the case. Nothing solid on that yet.
Though the Department of Justice is quiet as to its intentions, waiting until late Friday, as the Kern County Superior Court website showed a "new" item on its calendar for Sept. 8, when Dr. Pormir and Gwen Hughes have scheduled pre-prelim hearings, there was a third item: Motion to amend complaint.
Calls and emails came in asking me about this, and finally, with some certainty, we have learned that Pam Ott has been indicted. At this time we don't have the exact charges, but will get those to you after the holiday.
We will be in court on Tuesday, Sept.8, and we will have our cameras.
As to others who still linger at the hospital, there is no word, if there any other indictments coming up. We will be watching closely.
But I would say to the state, and its investigators, that Ott has been gone for two years, yet the problems remained. The nursing facility was reputed to be short staffed again, and high priced contracts, costing the hospital almost three million dollars, did not solve the problems.
Chief Financial Officer, Chet Beedle, has repeated many times since 2007, that the hospital has never been short staffed. Though he recently admitted to the fact that LVN's and RN's were supposedly doing the work of nurse's aides, who spend most of their working hours in direct contact with the residents, and some strongly disagreed with Mr. Beedle's observations.
In 2006, Ott, Beedle and Bob Jamison, indeed lead this community on a wild goose chase for a general obligation bond that would have not sufficed, and architectural plans that were not workable, and finally, watched the staff shrink in the nursing facility, care for residents compromised, then directed a stranger, a new director of nursing to order whatever pharmaceuticals she wanted, as Gwen Hughes was supposed to have years of experience regarding chemical restraints.


Documents from the hospital showed that Ott signed off on the skilled nursing facility annual surveys, yet, the state allowed her to get away with some serious stretching of the truth about the actual problems.

Employees claimed to be harassed and frightened, and most certainly overworked, dominated by an administration which stuck together refusing information about what was truly going on at the district.
And board members who hired Ott, with credentials from a diploma mill, appear to have allowed her to run roughshod over the district, employees, residents, patients, and even doctors.
The day after Ott stepped down, board member, Brad Armstrong, allegedly went into Ott's office, closed the door behind them, as human resources manager at the time, Michelle Rosado, fired several employees who were obviously thought to be a threat.
On that same day, Heidi Sage, Administrative Assistant, who worked in the CEO's office, was not at work while the terminations were taking place. Sage's mother, Tish Orr, who is a witness in the indictments, and someone I interviewed, went out on stress leave, because of the lack of help with the situation in the nursing center.
Armstrong has never answered to any questions regarding his role in the skilled nursing facility systems which failed. Or the short staffing where only the employees would say that they were not adequately staffed, and therefore care was compromised, but not the former chairman, Armstrong.
The twenty year board member (and that's what term limits are about folks, do you want 20 years of the same mistakes and attitude, or just 8?)
Armstrong, had an opportunity in 10/2006 to listen to the employees and order an investigation. But the chairman treated it like a mutiny, chastising the employees for not going up chain of command. Though the employees said they had already been to the CNO, Sharon Brucker, and Pam Ott, with Armstrong and the board, the open door policy slammed on their fingers.
This man, Bob Jamison, board member and local radio star, used blogs and his radio show to attack those who would believe that there were serious problems at the hospital.
He allowed, the now indicted, CEO, Pam Ott, to come for an hour on his talk show to give her side of the story. (See "Here's your witness Jerry Brown: Ott on QAB)
I asked Mr. Jamison at the last board meeting this month if Ott was indicted if he would take her back to the radio station and defend her.
His answer was just to stare at me.
My hope is that we clean out all the dirt, and that the people I have mentioned throughout this blog be put under oath and then tell their stories under the penalty of perjury.
This hospital needs to heal, Ott's indictment is a good start. But there are others who need to face their participation in the situation. Hopefully, in court, but if not, then there must be other ways to deal with them.

UPDATE:Breaking News: Kern Co. Superior Court shows Pharmacist Debbi Hayes sentenced on Friday
Update:
After making some phone calls, one to Pharmacist Debbi Hayes' attorney, Phyllis Hix, I know little more than I did last night.
I asked Hix for some clarification of the information on the website and she said, "no." I asked her for a statement and she said, "no." I asked if she will ever speak to me in the future and she said, "maybe."
I'm pretty sure Hix is either Military or has been deposed a half a million times. Usually I'm pretty good about getting at least a spoonful of info, but not this time. My worst interview before this aborted attempt with Hix was with the military.
Anyway, I do know now that Pharmacist Debbie Hayes is not in jail. On the website suspended sentence is underlined. It shows that she could have 3 years probation, according to the Kern County Superior court website.
It appears, but we will wait for word tomorrow, that all other 10 counts of elder abuse and assault have been dismissed, and Hayes has plead to the lesser charge of conspiracy.
The site also shows another court date for Hayes on Tuesday, August 18, as we will be there both Tuesday and Wednesday for the preliminary hearing in the cases against Dr. Hoshang Pormir and Gwen Hughes, we will keep you updated.
If anything else breaks in the meantime, we will be there with our cameras to catch it and bring it to you immediately.

As of right now, all I know is that information on the Kern County Superior Court website is showing that Pharmacist Debbi Hayes has plead "Nolo Contendere" to the additional conspiracy charge added to the ten counts against her, including elder abuse and assault.
The other charges have possibly been dropped.
The site is showing that there is still another court date on Tuesday, 8/18/09, but as of right now, it indicates she is sentenced to a one year term. (see below)
"Nolo Contendere" means a plea made by the defendant in a criminal action that is substantially but not technically an admission of guilt and subjects the defendant to punishment but permits denial of the alleged facts at other proceedings.
A very interesting move here on the part of the state. Not that its uncommon to get a plead, its cheaper, and if you have a crummy case to start with, its not a bad idea. They added a "conspiracy" charge meaning more than one person just to the Pharmacist's case, and then she pleads out to it.
Dr. Pormir and Gwen Hughes, the other current defendants have not had this charge put on their cases, as of today. And they are both still scheduled for a pre-preliminary and preliminary hearing Tuesday and Wednesday of next week.
This puts a big spin on this. Who's our other conspirator, there has to be one? And when will she and her friends be visiting the jail and court?

After making some phone calls, one to Pharmacist Debbi Hayes' attorney, Phyllis Hix, I know little more than I did last night.
I asked Hix for some clarification of the information on the website and she said, "no." I asked her for a statement and she said, "no." I asked if she will ever speak to me in the future and she said, "maybe."
I'm pretty sure Hix is either Military or has been deposed a half a million times. Usually I'm pretty good about getting at least a spoonful of info, but not this time. My worst interview before this aborted attempt with Hix was with the military.
Anyway, I do know now that Pharmacist Debbie Hayes is not in jail. On the website suspended sentence is underlined. It shows that she could have 3 years probation, according to the Kern County Superior court website.
It appears, but we will wait for word tomorrow, that all other 10 counts of elder abuse and assault have been dismissed, and Hayes has plead to the lesser charge of conspiracy.
The site also shows another court date for Hayes on Tuesday, August 18, as we will be there both Tuesday and Wednesday for the preliminary hearing in the cases against Dr. Hoshang Pormir and Gwen Hughes, we will keep you updated.
If anything else breaks in the meantime, we will be there with our cameras to catch it and bring it to you immediately.

Okay, Donny Fong, Jerry Brown, I'm sending you the information, but with some hesitation
"Injustice anywhere, is a threat to justice everywhere," Martin Luther King Jr.
As I'm sitting here, paperwork scattered all around me, digging through the past to turn this information over to the Department of Justice for their potential "real" investigation, including our old Diva, or CEO, Pam Ott, I cannot help but be bothered by certain things.
Oh, those things which don't add up, niggle at me, until I can hardly sleep.
Like these documents which clearly show that Pam Ott, the hospital board, the board's counsel, the CNO, the staff, all mandated reporters, knew about the problems, which included serious short staffing, and mismanagement.
A mandated reporter is anyone who knows or even just suspects there might be elder abuse. Similar to a good samaritan. You don't have to be a nurse or doctor, you could be a visitor, a maintenance person, a dietitian, a secretary, an accountant, but you have to notify someone if you think there is a problem.
My question to the state is if you took three why didn't you take everyone based on the elder abuse mandated reporting laws?
Or were the investigators fooled and easily manipulated like the rest of us into believing the leadership on the board and administration, human resources, were just "victims?"
And I'm wondering why the state's current case is so limited in its scope, and so out of touch with what really happened to cause the system failure in the KVHD skilled nursing facility?
It couldn't be simply the use of psychotropic drugs, as they are legal, prescribed and administered everyday in nursing homes across the country.
And when I say system failure that goes up the ladder doesn't it. You can't tell me there aren't pages full of penal codes that could've been used to punish the real problems at the top.
But it would take effort and money. It's a long story we have at KVHD, but once understood, it could be clarified in court.
It's not impossible. We know there are many laws supporting cases like this including the "whistle blower" act which I believe was enacted in response to the Enron scandal. What is peculiar to Enron is that the problem was at the top.
Enron wasn't the only paper shredding, employee bullying, justice obstructing organization, (KVHD) and hence laws were written to deal with that type of situation.
Employees of this hospital work for the biggest employer in the valley, and that should have been factored into this case, because it shows reasons for the actions and inactions of some of the staff.
Justice is just a word, the action behind that ideal is what counts. Calling what we have seen here at KVHD justice, would be like me calling Pam Ott's leadership, healthcare reform.
Elder abuse may have been a result of mismanagement, but it happened because the hospital let it happen. In fact they refused to stop the insanity and they were aided and abetted by big brother.
Let me tell you when the "sticky three" board members, (Brad Armstrong, Bob Jamison, and Barbara Casas) the CEO, CFO and others who knew the situation at the nursing facility, and for that matter, in the hospital in general, were let "off the hook" they thought they were impervious.
The DOJ, the Department of Health Services, the Kern County District Attorney's office, actually gave the criminal element at KVHD the confidence to freely short staff, allow an old system and old guard to remain in power, and then watch as leadership stepped down and ran out of town, untouched.
Yet the three people blamed, indicted, are gone, and the problems continued. Why? An inadequate investigation maybe?
Just three months ago, before a recent change in management, I walked in to the nursing center one day to find the staffing sheet not filled out and was told the SNF survey was not "ready" to be looked at by the public.
The hospital has spent almost three million dollars on the nursing facility consultants and temporary staff since the meltdown in 2007, yet the basics were not covered.
And in my opinion, there was no oversite of these administrators, no oversite of the money on the contracts, no oversight of personnel and policies, staffing, and a general attitude that if we close our eyes it will go away. As long as there were no reports from DHS, then it was considered good.
As a self reporting facility, the hospital adminstrator is required by law to report to the state any problems. I guess if you don't report it, then there are none. (Yeah.)
Complaints were recently revealed at our August board meeting regarding the use of "pink ladies" (not the drink) in the skilled nursing facility.
It was said that these volunteers spoke with Tracy Brown, the former nursing home administrator, and another former CEO, Rick Carter. They said they were not heard and nothing was done about their concerns.
It's a year later and finally these people spoke up. I think it is because they are beginning to believe things can change if you continue to do the right things, speak out, and not play small town, I'm a big fish, politics.
The DOJ has another chance to do something that they may not even know they can do, and that is to correct the situation, for all of us.
I know Mr. Fong's career is not going to be made here in the Kern River Valley, so I don't imagine he has too many sleepless nights over the dung trap of deception which occurred here. But his decisions regarding this case, will certainly make or break the careers of others. And they will either help or hinder this valley and its ability to get decent healthcare.
I need to know if the state Attorney General, Edmund G. Brown Jr., and investigator, Donny Fong, really want the truth or do they want to wrap this up and run off, forgetting all about us?
I'm concerned about the conspiracy charge against the Pharmacist, Debbi Hayes. I can't believe it's simply a coincidence that the upcoming preliminary hearing next week didn't have something to do with the new charge, and the new investigation of Pam Ott.
And again, conspiracy meaning more than one person, makes me wonder what the state is up to.
I truly want to send these documents to Mr. Fong, but I hesitate, wondering if they will not try to use this information in some other manner rather than in context to what has happened.
The state's case is really based on paperwork and Dr. Locatell an expert witness. The state's witnesses have already told me they will be hostile in court. Their own witnesses didn't believe in the investigation. That is a strong message.
But what is also of interest is that Pam Ott is a witness in the case. Which again makes me wonder about motivations here.
And the CNA (Certified Nurses Aide) I interviewed at least five times, told me the story of the day she showed up to work at the SNF in January of 2007. (The DOJ never interviewed her or so many others)
"All the nurses were crying, throwing away bottles of medicine in the trash. They were tearing down the care plans in the patients rooms, in the closets, which were outdated anyway...some people had died but the plans were never changed."
The state is basing a lot of information on paperwork. That should be "noted."
It's a quandry for me right now whether to send or not to send to the state. I'm wondering if these documents are better for the defense.
I'm questioning if the state's sudden interest in people other than the three they have charged, has to do with bolstering their own version of events, as errant as they are.
Really, its sad that I have to even question whether or not to send this to the state, whether I can trust the courts, the investigators, the attorney general.
But I am going to pray that there is integrity left in someone, and that this information will be used for that higher purpose. I really have no other choice except to trust.
